Full Breakdown
Florida law prohibits home cultivation of cannabis for any purpose. Medical marijuana under FL 381.986 (2016 constitutional Amendment 2 and implementing legislation) is dispensed exclusively through licensed Medical Marijuana Treatment Centers (MMTCs). Qualified patients with physician certifications may possess medical cannabis in forms dispensed by MMTCs but cannot grow their own. Recreational cannabis remains illegal; Florida Amendment 3 (recreational legalization) failed in November 2024. Cultivation of any amount is a felony under FL 893.13. Federal law (Controlled Substances Act Schedule I) also prohibits cultivation. Apopka has no ordinance authorizing home grow and cannot authorize what state law forbids.
Violations & Fines
Cultivation any amount: third degree felony up to 5 years prison and 5,000 dollar fine. 25 or more plants: second degree felony. Near school: enhanced penalties.
