Home cultivation of cannabis is illegal in Florida. State law (FL Statutes Ch. 381 and Ch. 893) restricts cannabis to the medical marijuana program administered by the Florida Department of Health. Qualified patients may possess medical cannabis products purchased from licensed dispensaries but cannot grow cannabis plants at home. Cultivation of any cannabis plant is a felony under Florida law.
Florida's medical marijuana program (Amendment 2, 2016; FL Statute Β§381.986) allows qualified patients to purchase and possess medical cannabis products from licensed Medical Marijuana Treatment Centers (MMTCs). However, home cultivation of cannabis plants is strictly prohibited. Growing even one cannabis plant is a third-degree felony under FL Statute Β§893.13. Orlando enforces state law and has no local ordinance permitting home cultivation. As of 2025, Florida voters rejected a recreational cannabis amendment (Amendment 3) in November 2024.
