Odor complaints are generally not actionable under state preemption. Cultivators may not sell homegrown cannabis -- personal use only. Medical marijuana patients under AMMA (Arizona Medical Marijuana Act) may also cultivate if they live more than 25 miles from a licensed dispensary.
Exceeding 6 plants per person or 12 per household is a petty offense for the first violation (civil penalty up to $300) under ARS 36-2853. Growing in an area accessible to minors or visible from public spaces may result in criminal charges. Sale of homegrown cannabis remains a felony under Arizona law.
