Growing marijuana at home is illegal everywhere in Indiana, including Elkhart County. Indiana has no medical or recreational marijuana program. Cultivating plants is prosecuted as possession of marijuana, a Class B misdemeanor at minimum under IC 35-48-4-11, rising with prior convictions.
Indiana is a full-prohibition state: there is no legal recreational or medical marijuana, and no lawful home cultivation. IC 35-48-4-11 makes it a Class B misdemeanor to knowingly or intentionally possess marijuana, and the same statute reaches anyone who grows or cultivates marijuana or, knowing it is growing on their premises, fails to destroy the plants. A prior drug conviction raises the offense to a Class A misdemeanor or a Level 6 felony. Only low-THC products, hemp-derived CBD at or below 0.3% THC, are legal, and they are regulated separately from marijuana. No local permit or card changes this.
Possession of marijuana is a Class B misdemeanor carrying up to 180 days in jail and a $1,000 fine; a home grow is charged as possession and escalates with prior drug convictions.
