Flower Mound, TX Cannabis Regulations: Home Cultivation (2026)

Cannabis home cultivation is illegal in Flower Mound and the entire state of Texas. Texas Health and Safety Code Chapter 481 (Texas Controlled Substances Act) classifies marijuana as a Schedule I controlled substance under Penalty Group provisions. Possession of a usable quantity of marijuana is a criminal offense regardless of intent. Possession of two ounces or less is a Class B misdemeanor punishable by up to 180 days in jail and a $2,000 fine. Possession of two to four ounces is a Class A misdemeanor punishable by up to one year in jail and a $4,000 fine. Larger quantities carry felony charges with escalating penalties. Cultivation of marijuana plants constitutes manufacture under Texas law and carries penalties based on the aggregate weight of all plant material, which is typically charged as a felony. The Texas Compassionate Use Program (TCUP) under Chapter 487 allows licensed dispensing organizations to provide low-THC cannabis oil (maximum 0.5% THC) to patients with qualifying medical conditions, but home cultivation is not permitted under any provision of TCUP. No Texas municipality has the authority to legalize or decriminalize marijuana possession or cultivation in conflict with state law. Flower Mound Police Department enforces state drug laws.
