Full Breakdown
Florida Statute 381.986 governs medical cannabis through a vertically integrated licensing system in which only Medical Marijuana Treatment Centers (MMTCs) may cultivate, process, and dispense cannabis to qualified patients. Patients receive product only through licensed MMTC dispensing facilities. There is no provision in Florida law for medical or recreational home cultivation, and cannabis cultivation outside an MMTC remains a felony under Florida Statute 893.13. Pinellas County does not adopt a separate cultivation ordinance; the county defers to state law and prosecutes home grows through state criminal channels rather than local zoning.
Violations & Fines
Cultivating cannabis outside a licensed MMTC is a third-degree felony under Florida Statute 893.13, escalating with plant count and proximity to schools, with concurrent forfeiture of property and equipment.
