Article X of Chapter 34 goes well beyond the state's bare right to grow. Sec. 34-901 flatly bans outdoor cultivation of cannabis anywhere in the city. Sec. 34-902(b) makes it unlawful to plant, cultivate, harvest, dry or process cannabis inside a residence or accessory structure without first obtaining a valid indoor personal cultivation permit from the development services director. The application requires notarized written consent from the legal property owner, and the director issues a permit good for two years listing the permittee's name, permit number, address and any added conditions, per Sec.

34-902(c) and (i)(1); only one permit is allowed per residential unit regardless of how many people live there. Growing is capped at six plants of any size or stage per residence (Sec. 34-902(d)(1)f), all cultivation must occur entirely inside the residence or accessory structure, kitchens, bathrooms and primary bedrooms cannot be repurposed for it, generators and bottled gas are banned indoors for cultivation, and grow lighting cannot exceed 1,200 watts. No plants, equipment, odor, light or heat may be detectable beyond the property line. The director may inspect on 72 hours' written notice, and refusing entry is grounds for permit revocation.

Selling or transferring cannabis grown under the permit is unlawful, and providing it to anyone under 21 is unlawful. Sec. 34-904 makes any violation other than the separate smoking rule in Sec. 34-903 a misdemeanor, chargeable per day. Permit denials and revocations can be appealed to a city manager-appointed hearing officer under Sec. 30-129, with further judicial review available under Code of Civil Procedure Sec. 6.
