California Health & Safety Code Section 11362.2 allows adults 21+ to cultivate up to 6 plants per residence indoors. Truckee permits indoor personal cultivation only; outdoor personal cultivation is prohibited within Town limits.
Under California Proposition 64 (H&S Code 11362.2), adults 21 and older may possess, plant, cultivate, harvest, and process not more than 6 living cannabis plants per private residence. Cities may reasonably regulate but not prohibit indoor personal cultivation. Truckee allows indoor personal cultivation consistent with state law but prohibits outdoor personal cultivation within Town limits and prohibits any commercial cultivation. Plants must not be visible from public rights-of-way and must be in a fully enclosed, secured area.
Outdoor personal cultivation or cultivation exceeding 6 plants per residence is a misdemeanor under H&S Code 11358 with fines up to $500. Unauthorized commercial cultivation triggers state penalties up to $30,000 per violation under B&P Code 26038.
