Summary

In unincorporated Elko County, Nevada, Section 7-5-3 bars anyone under 18 from public places between 10:30 P.M. and 6:00 A.M. on school nights, and between midnight and 6:00 A.M. on nonschool nights, unless with an adult or on an exempt errand or job. Parents and public-place operators face separate misdemeanor liability.

These county ordinances apply to unincorporated areas of Elko County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

It shall be unlawful for any minor to remain, idle, wander, stroll or play in any public place either on foot or to cruise about without a set destination in any vehicle in, about or upon any place in the County between the hours of ten thirty o'clock (10:30) P.M. and six o'clock (6:00) A.M. on school nights and twelve o'clock (12:00) midnight and six o'clock (6:00) A.M. on nonschool nights unless accompanied by a parent, guardian, custodian or other adult person having custody or control of such minor or unless the minor is on an emergency errand or specific business or an activity directed or permitted by his parent, guardian or other adult person having the care and custody of the minor or where the presence of such minor is connected with or required by some legitimate employment, trade, profession or occupation.

Full Breakdown

The Elko County Curfew Ordinance, Title 7, Chapter 5 of the Elko County Code, defines the County as the unincorporated areas of Elko County, so it does not reach the cities of Elko, Carlin, Wells or West Wendover. A minor is any person under the age of eighteen. A public place is any street, alley, highway, sidewalk, park, playground or other place to which the public has access, and it expressly includes a store, shop, restaurant, tavern, bowling alley, cafe, theater, drugstore, poolroom or shopping center, together with the front and immediate area around them.

Section 7-5-3 bans a minor from remaining, idling, wandering, strolling or playing in a public place, on foot or cruising without a set destination in a vehicle, between 10:30 P.M. and 6:00 A.M. on school nights and between 12:00 midnight and 6:00 A.M. on nonschool nights. The exceptions are a minor accompanied by a parent, guardian, custodian or other adult with custody or control, a minor on an emergency errand or specific business or activity directed or permitted by that adult, and a minor whose presence is connected with or required by legitimate employment, trade, profession or occupation. Section 7-5-6 exempts a minor attending a church, school or club function that runs later, provided the organization notifies the Elko County Sheriff's Office in advance of the function and its end time.

Section 7-5-4 makes it unlawful for anyone operating a public place to knowingly permit minors to be present during the curfew hours. Section 7-5-5 makes it unlawful for a parent or guardian to allow a minor, through ineffective control, to be on streets, sidewalks or public places during those hours, with a further exception when the adult has made a missing person notification to the Sheriff's office.

Section 7-5-7 sets the procedure. A Sheriff's deputy records the minor's name and address, warns the minor, directs the minor home and notifies the parents. A minor who refuses, lies about a name, or was warned before is taken to the Sheriff's Office or nearest substation, and if no adult comes the minor is released to juvenile authorities.

Violations & Fines

Under Section 7-5-8, a minor who violates the chapter is processed in accordance with juvenile court law and procedure. A parent, guardian or other adult with care and custody of a minor, after being previously notified under Section 7-5-7, is guilty of a misdemeanor and fined not more than $1,000 for each offense.

Frequently Asked Questions

What are the curfew hours in unincorporated Elko County?
Section 7-5-3 sets 10:30 P.M. to 6:00 A.M. on school nights and 12:00 midnight to 6:00 A.M. on nonschool nights. The ban covers any minor, meaning anyone under eighteen, who remains, idles, wanders, strolls or plays in a public place, or cruises in a vehicle without a set destination.
Who is exempt from the curfew?
A minor accompanied by a parent, guardian, custodian or other adult with custody or control is exempt. So is a minor on an emergency errand, on specific business or an activity directed or permitted by that adult, or whose presence is required by legitimate employment, trade, profession or occupation.
Can a minor stay out late for a school or church event?
Yes, if the church, school, club or other organization notifies the Elko County Sheriff's Office in advance of the function and the time it will end. Section 7-5-6 then exempts attending minors from Section 7-5-3, but they must be at home or their usual place of abode promptly after it ends.
What happens to a parent whose child breaks curfew?
A deputy first warns the minor and notifies the parent. A parent or guardian who, after that prior notification under Section 7-5-7, again permits a violation is guilty of a misdemeanor and fined not more than $1,000 for each offense under Section 7-5-8. The minor is handled under juvenile court procedure.
