Madison General Ordinance Β§25.09 imposes a juvenile curfew on persons under 17 years of age. Curfew hours are 11 PM to 5 AM Sunday through Thursday, and midnight (12 AM) to 5 AM Friday and Saturday. Exceptions include: accompanied by parent/guardian, traveling to/from lawful employment, attending a school/religious/civic event sponsored by a recognized entity, responding to an emergency, exercising First Amendment rights, or engaged in interstate travel. Sun Prairie, Fitchburg, Middleton, Verona, Stoughton, Monona, Waunakee, DeForest, Oregon, and McFarland each have similar ordinances β ages range from under-16 to under-18, and hours vary slightly. Wisconsin Statute Chapter 938 (Juvenile Justice Code) provides the state framework allowing municipal curfew ordinances. Parents/guardians can be cited under many local ordinances for 'permitting' curfew violations. Enforcement is typically police returning the minor home with verbal warning on first contact, graduating to citations and municipal court referrals on repeat encounters. UW-Madison students 17+ are not subject to juvenile curfew.
First offense: warning and parental notification. Repeat violations: $50 to $500 fine to minor and/or parents. Habitual: referral to Dane County juvenile court under WI Ch. 938.
