Summary

Section 5-2-3 makes it unlawful for a parent or guardian to knowingly allow a minor to violate curfew, and § 5-2-4 extends liability to any business that knowingly lets a minor stay on the premises during curfew hours, unless the minor is lawfully employed there.
Section 5-2-5 separately bars anyone from helping a minor break curfew. Section 5-2-7 makes any presence on the street beyond the curfew hours prima facie evidence of a violation, shifting the practical burden to the minor or parent to show an exception applies.
Violations & Fines
Curfew violations are enforced under § 5-2-8: a minor found in violation is subject to arrest and citation and is returned to a parent or guardian's custody. A parent or guardian who knowingly refuses to retrieve the minor within a reasonable time is separately guilty. Any person who violates this chapter, including a parent, guardian or business, is guilty of a class B misdemeanor under § 1-4-1.
