Bozeman, MT Curfew Laws: Park Curfew (2026)

Park hours are set by Bozeman Municipal Code section 26.02.200. Subsection A opens all parks to the public every day of the year, subject to the closures described in the section. Subsection B lets the director close any section or part of any park, and the director must post notice of the closing in a conspicuous manner. Subsection C is the night closure. Between 11:00 p.m. and 5:00 a.m., no person is allowed to be physically present within the boundaries of any park unless the director has given written permission. The one carve-out on the face of the section is designated camping areas.

The definition of park in section 26.02.020 is broad. It means a park, playground, recreation complex or any other area in the city, developed or undeveloped, owned or used by the city and devoted to active or passive recreation. The night closure therefore reaches undeveloped city recreation land as well as playgrounds.

The closure is backed by the park prohibitions in section 26.02.030, which make it unlawful to be in a park or recreational facility after it has closed, either because of the night closure or because of a closure following public notice or posting. That covers both the standing 11:00 p.m. closure and a temporary closure the director has posted.

Other park rules follow the same clock. Section 26.02.140 ties skateboard facility hours to the operation of all other park facilities, requires the hours to be posted, and closes those facilities in inclement weather. Section 26.02.040 ends music played inside a park structure by 10:00 p.m. and limits amplified sound to 12:00 noon through 9:00 p.m. with the director's approval.

Section 26.02.160 lets the director, city manager, fire chief or police chief enforce the article, and the director or any police officer can issue a citation.
