Section 58-8(b) makes it unlawful to enter any portion of a park or recreation area that is closed, and a closure cannot exceed 28 days without City Council approval.
(a) The city manager and/or the director, should it be found reasonably necessary, may at any time close any park or part thereof for all uses or certain uses. Said closure shall not exceed 28 days without the approval of the city council. (b) It shall be unlawful for any person to enter any portion of a park or recreation area which is closed to the public. Hours during which the area is open to the public shall be posted by the director. Unless otherwise posted by the director, the hours during which parks and recreation areas are open to the public are 5:00 a.m. to 11:00 p.m. Park closing times shall not apply to the following: (1) Department-sponsored/sanctioned functions including athletic events, leagues or tournaments. (2) Activity permitted by the director in accordance with this article to exceed closing times. (3) City employees, city officials, and law enforcement officers in the exercise of their official duties.
Full Breakdown
Section 58-8 of the Burleson Code of Ordinances has two subsections. Subsection (a) covers closures: the city manager and/or the director, should it be found reasonably necessary, can at any time close any park or part of one for all uses or certain uses. A closure cannot exceed 28 days without the approval of the city council. Subsection (b) covers daily hours. It is unlawful for any person to enter any portion of a park or recreation area which is closed to the public, the director posts the hours the area is open, and unless the director posts otherwise the hours are 5:00 a.m. to 11:00 p.m. Because the default applies only unless otherwise posted by the director, the sign at the entrance controls over the 5:00 a.m. to 11:00 p.m. window at that park.
Three groups are outside the closing times: department-sponsored or sanctioned functions including athletic events, leagues or tournaments; activity the director has permitted to exceed closing times in accordance with the article; and city employees, city officials, and law enforcement officers in the exercise of their official duties. A permit is the route for anyone else. Section 58-27 requires a director's permit before any use involving amplified sound and/or artificial lighting, before any public meeting or gathering on park property that attracts or can be expected to attract more than 50 but less than 500 persons at any instant, and before organized team or league sporting events on park fields or courts not covered by a separate facility use agreement.
Closing time also affects vehicles. Under § 58-5(c) it is unlawful to leave a vehicle, including trailers, parked within the confines of any city park after the park is closed without first obtaining a permit from the director, and the director can have unauthorized vehicles towed or removed at the registered owner's expense. Overnight presence is addressed in § 58-17: no person shall camp or stay overnight in a public park, except as part of an activity sponsored by the parks department. Section 58-14 separately bars bathing at all times and limits swimming to areas the director designates, during hours designated for swimming.
Violations & Fines
Section 58-8 prints no penalty of its own, so the general penalty in section 1-14 applies: a fine not exceeding $500.00 where no specific penalty is provided, with each day a violation continues a separate offense unless otherwise provided. A vehicle left in a park after closing is subject to towing or removal at the registered owner's expense under § 58-5(c), and § 58-25 makes it unlawful to remain after a parks employee or peace officer asks you to leave for disrupting a park program.
