Full Breakdown
Section 20-13(b) sets the hours of operation for each city park at sunrise to sunset. Two parks are different: Paws Dog Park opens at 5:00 a.m. and closes at 10:00 p.m., and Wingate Park hosts athletic events on lighted fields. The section names the parks it covers: 12th Avenue South Park, Carver Center, Cradle Creek Preserve, Gonzales Park, Fountain View Park, Oceanfront Park, Paws Dog Park, Penman Park, Rotary Park, Seawalk Pavilion and Latham Plaza, South Beach Park and Sunshine Playground, Tall Pines Park and Wingate Park.
Section 20-13(c) makes it unlawful to trespass when the park is closed or to camp overnight, unless the city manager has issued authorization. Related prohibitions in the same list bar sleeping or lounging on park benches, tables or under any pavilion, and residing or living in the parks on a temporary or permanent basis. No sun or shade apparatus can remain in place overnight in any park.
Section 20-4 covers the beach as well as parks. No person shall enter or remain on the beach or in parks or on park property without a permit during closing hours, or after receiving notice of the closing hours from a city employee acting within the scope of official duties. No person who has violated a park rule shall remain after a police officer, sheriff's deputy or city employee requests them to leave. Section 20-6(b) requires every park to have at least one prominently posted sign stating its hours, and section 20-6(c) lets the city manager close any section of a park at any time.
Vehicles are covered too. Under section 20-9(d), no vehicle shall be left overnight in any park or beach parking lot area unless authorized by the city manager or designee, the director, or in emergencies. On the Atlantic Ocean Beach, section 6-45(c) bars camping or sleeping from sunset to sunrise without first receiving permission from the city manager.
Violations & Fines
Under section 20-18(b), anyone found violating the chapter shall be ordered to leave all parks, beaches and recreation facilities for a minimum 48-hour period, and a person who fails to leave can be arrested and prosecuted for trespassing. The director or a law enforcement officer can also order a violator to stay out for a period not to exceed six (6) months. A violator is entitled to a hearing before the special magistrate on a written request made within three (3) days of the order.
