Full Breakdown

Section 132-4A of the Lower Paxton Township Code, Hours of operation, sets the park curfew. Recreation, park and conservation areas are open daily to the public from official sunrise to official sunset. Lighted courts and fields are the exception and are open from official sunrise until 10:00 p.m. Eastern Standard Time and Daylight Saving Time. It is unlawful for any person, other than Township personnel conducting Township business, to occupy or be present in a park during any hours in which the park is not open.

Permits must be obtained for use after official sunset or after the 10:00 p.m. closing time for specific activities, and the permit paperwork runs through the Parks and Recreation Department under § 132-4B, which lists park pavilion, ball field and court, Heroes Grove Amphitheater, special event and park vending applications. Any section or part of a park can also be declared closed at any time and for any interval, either temporarily or at regular or stated intervals, and entering or occupying a closed area contrary to posted regulations is unlawful.

Section 132-4E adds that all parking is prohibited after regular closing time, and vehicles parked contrary to posted regulations and times can be removed by the Township at the owner's expense. Section 132-7K separately makes it unlawful in any park to disturb the peace, endanger safety, drink alcohol or violate any rule made or approved by the Department of Parks and Recreation. Section 132-8 gives the Township Manager and the Manager of Parks and Recreation administrative authority, and the Township Police can end the conduct, expel the person or file a complaint with a District Magisterial Judge.

Violations & Fines

Section 132-9 makes violations summary offenses before a District Justice under the Pennsylvania Rules of Criminal Procedure. Conviction carries a fine of not more than $1,000 or imprisonment not exceeding 90 days. Each day or portion of a day that a violation continues is a separate offense. Under § 132-4E, a vehicle left after closing can be removed by the Township at the owner's expense.

Recreation, park and conservation areas are open daily from official sunrise to official sunset under § 132-4A.
