Under Modesto Municipal Code §§ 12-4.202 and 12-4.203 (Title 12 – Parks, Recreation and Neighborhoods), city parks are open from dawn to dusk. Presence in a park outside posted hours—including after dusk—constitutes an after-hours violation and may be treated as trespassing. Section 12-4.207.1 establishes additional prohibitions such as consumption of alcohol without a permit, camping, fires without authorization, and discharge of firearms. Modesto Police Department enforces park rules; citations are issued as infractions. Special-event permits may authorize after-hours use at specific parks.
After-hours park presence is an infraction punishable by fine; repeat or aggravated violations may be charged as misdemeanors under California Penal Code § 602 (trespassing).
