Summary

Baltimore County lets a data center or energy storage device locate in the R.C.5 Zone, including inside the Chesapeake Bay Critical Area, under a dedicated set of bulk standards in BCZR § 443.1. Principal structures top out at 60 feet, setbacks run as low as 10 feet from any lot line, and the section carries no lot-coverage cap at all.

These county ordinances apply to unincorporated areas of Baltimore County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A.Location requirements. Notwithstanding any provision of these regulations to the contrary, a data center or energy storage device may be permitted within the Chesapeake Bay Critical Area. This subsection shall not be interpreted to require a data center or energy storage device to be located within the Chesapeake Bay Critical Area.B.Bulk standards. A data center or energy storage device developed under this section is subject only to the following setback, height, and area requirements:1.The minimum setback from any lot line or street line shall be 10 feet.2.The minimum setback may be reduced to zero for the purposes of integrating, adjoining, or connecting structures on contiguous lots with the expressed approval of the owner of the contiguous lot.4.The maximum height of principal structures associated with a data storage or energy storage device shall be 60 feet. Interconnection equipment, poles, or other ancillary support structures shall not be considered as principal structures.5.There is no lot coverage requirement.C.Parking. The minimum number of off-street parking spaces provided shall be one space per employee on the largest shift.

Full Breakdown

A opens the door for a data center or energy storage device to be sited within the Chesapeake Bay Critical Area, while making clear the section does not require that siting, leaving the option available without mandating it. 2. Principal structures are capped at 60 feet, though interconnection equipment, poles and other ancillary support structures do not count as principal structures and so are not bound by that height cap. 5 states there is no lot coverage requirement at all for a data center project, a departure from standard density limits elsewhere in the zoning regulations.

H. Zone's sign standards under Subsection D, and Subsection E requires a landscaping buffer wherever the facility adjoins residentially zoned or used property, though landscaping is not required in already-vegetated areas or where it would conflict with wetlands or habitat rules. 5 Zone under Subsection H, and Subsection G makes the section control over any conflicting zoning provision.

Violations & Fines

Constructing a data center or energy storage device that exceeds the 60-foot height cap, sits closer than the 10-foot minimum setback without the contiguous owner's written approval, or skips the required landscaping buffer next to a residential property is a zoning violation the Department of Permits, Approvals and Inspections can act on. Because § 443.1.H confines the entire bulk package to the R.C.5 Zone, a facility built outside that zone under these relaxed standards would also be out of compliance and subject to the general zoning rules for its actual district instead.

Frequently Asked Questions

How tall can a data center be in Baltimore County?
Principal structures are capped at 60 feet under BCZR § 443.1.B.4. Interconnection equipment, poles and other ancillary support structures are not counted as principal structures, so they are not subject to that 60-foot limit.
Is there a lot coverage limit for data centers?
No. Section 443.1.B.5 states plainly that there is no lot coverage requirement for a data center or energy storage device built under this section, unlike most zoning districts that cap the percentage of a lot that can be covered by structures.
Can a data center be built anywhere in the county?
No. Section 443.1.H limits this entire bulk-standards package, including the reduced setbacks and uncapped lot coverage, to the R.C.5 Zone. A project outside that zone would be reviewed under the standard rules for its own zoning district.
What setback does a data center need from its neighbors?
A minimum of 10 feet from any lot line or street line under § 443.1.B.1, though that can drop to zero if the owner of an adjoining lot expressly approves integrating or connecting structures across the property line.
