Summary

Orange treats drones as a 'game' object under its Park Ordinance: flying one in a City park is barred everywhere except in areas set apart and posted with signage for that purpose, or during an approved recreation program, under Municipal Code Section 12.48.060.

No person shall engage or abet in the playing of any game involving thrown or otherwise propelled objects, including, but not limited to, balls, stones, arrows, javelins, drones, model airplanes, rockets, motorized model cars or motorized remote control devices except in areas set apart or identified by appropriate signage for such purposes or during an approved recreation program.

Full Breakdown

060, titled 'Games,' bars playing or abetting any game involving thrown or otherwise propelled objects in a park, and it names drones specifically alongside balls, stones, arrows, javelins, model airplanes, rockets, motorized model cars and other motorized remote-control devices. ' The only ways to legally fly a drone in an Orange park are inside an area the Department of Community Services has set apart or posted with signage for that purpose, or as part of an approved recreation program. Because the section groups drones with 'propelled objects' rather than singling them out with separate technical standards, the City has not published altitude, weight or registration rules of its own for park drone flights; the designated-area/signage and program-approval limits are the entire local standard. 020.

Violations & Fines

Flying a drone outside a posted or designated area, or outside an approved recreation program, is a misdemeanor under Section 12.48.125(A): a fine of not more than $1,000.00, imprisonment in the County Jail for not more than six months, or both. The Trial Court may instead reduce the charge to an infraction under Section 1.08.010, punished by a fine of up to $100.00 for a first violation, $200.00 for a second within a year, and $500.00 for each further violation within that year. The Director or a designee may also eject a violator from the park facility on the spot under Section 12.48.125(C), and any police officer, animal control officer, park ranger or code enforcement officer may enforce the section under Section 1.08.010.

Frequently Asked Questions

Can I fly a drone in an Orange city park?
Only inside an area the City has set apart or marked with signage for that purpose, or as part of an approved recreation program. Section 12.48.060 classifies drones with other thrown and propelled objects like model rockets and RC cars, and bans that entire category everywhere else in the park, including Plaza Square, which the Park Ordinance expressly covers under Section 12.48.010.
Does the drone rule apply only to City-owned parks, or also to Plaza Square?
It covers Plaza Square along with every other public park, playground and recreation facility in the City. Section 12.48.010 states the chapter's rules 'shall govern public parks, playgrounds, and recreation facilities in the City, including Plaza Square,' so the same designated-area limit on drones applies there too.
What's the penalty for flying a drone in an Orange park outside a designated area?
It's a misdemeanor under Section 12.48.125(A), carrying a fine up to $1,000.00, up to six months in County Jail, or both, though a court can reduce the charge to an infraction with escalating fines starting at $100.00. A park officer can also immediately eject the violator under Section 12.48.125(C).
