California provides robust drone privacy protections even where federal airspace rules allow flight. Civil Code §1708.8 creates civil liability for: (a) physical invasion of privacy — knowingly entering airspace over someone's land to capture images, recordings, or sounds of them engaged in a private, personal, or familial activity; (b) constructive invasion — using any device to capture images that could not otherwise be obtained without physical trespass.
