These county ordinances apply to unincorporated areas of Essex County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No person shall operate a UAS/drone in violation of any applicable state and federal laws and regulations as are now or as may be hereafter adopted, including but not limited to 14 CFR 1 et seq., and N.J.S.A. 2C:40-27 et seq.

I. Ice-covered bodies of water. No person shall walk, coast, ice skate, sled or otherwise engage in any activity upon any ice-covered ponds, streams, lakes, or other bodies of water within any County park or property unless otherwise authorized or permitted by the Director in designated areas and during specified times.

Full Breakdown

Section 74-20H(2) of the parks code requires that any UAS/drone operation on Essex County park property comply with applicable state and federal law, expressly citing 14 CFR 1 et seq. (FAA regulations) and N.J.S.A. 2C:40-27 et seq., New Jersey's unmanned aircraft statute. This means county permission to fly under § 74-20H(1) does not override federal airspace rules or the state's own drone restrictions, a park permit satisfies only the county layer of drone regulation, not the separate federal or state layers that still apply on top of it whenever a drone is flown from park land.

Violations & Fines

Operating in violation of FAA rules or N.J.S.A. 2C:40-27 on County park property is a separate offense on top of the chapter's general penalty under § 74-6.1(C).
