Full Breakdown

Chapter 130 of the Code of the County of Essex handles winter roadway rules in two articles. Article II, adopted 11-6-2014 by Ord. No. O-2014-00017, deals with parked vehicles. Under § 130-6, any unoccupied or unattended vehicle parked or standing on a County road while that road is snow-covered is deemed a nuisance and a menace to the safe and proper regulation of traffic, and it shall be removed. The trigger is the condition of the road, not a posted route or an alternate-side calendar: the text reaches every County road whenever it is snow-covered, and it reaches only vehicles that are unoccupied or unattended.

Section 130-7 puts the bill on the owner. The owner of a vehicle parked or standing on those roads must pay the reasonable cost of removal and storage, as provided in the Code of the County of Essex § 44-22, before regaining possession. Article II prints no separate fine, so the consequence of leaving a car on a snowy County road is the tow and the storage charges.

Article III, adopted 2-21-2018 by Ord. No. O-2018-00004, regulates the people who clear snow. Section 130-8A prohibits any owner, occupant, or other person of premises adjacent, abutting or otherwise fronting a County road from discharging, dumping, shoveling, piling, pushing, blowing, plowing or otherwise depositing snow onto the road. Subsection B extends that to anyone who causes, sanctions or authorizes the activity, which reaches a landlord or a hired plow contractor. Subsection C adds a duty about accumulation: no person shall create or permit a pile of snow on frontage property in a way that obstructs or impedes the safety of the traveling public or the County's snow removal operations.

Subsection D sets the penalty. A person who violates Subsection A, B, or C is liable, upon conviction, to a fine of $150 for the first offense and $300 for each subsequent offense.

Two limits matter. These articles cover County roads, so municipal streets in Newark, Montclair and the other Essex municipalities follow their own local snow rules. Article IV of the same chapter, on emergency no parking, is a separate weather-triggered mechanism that works through posted temporary signs.

Violations & Fines

Leaving an unoccupied or unattended vehicle on a snow-covered County road under § 130-6 gets the vehicle removed, and under § 130-7 the owner pays the reasonable removal and storage cost before regaining possession. Depositing snow on a County road or letting frontage snow obstruct traffic or plowing under § 130-8 carries a fine of $150 for a first offense and $300 for each subsequent offense, upon conviction.

Frequently Asked Questions

Can my car be towed from an Essex County road after it snows?
Yes, if the road is a County road, it is snow-covered, and the car is unoccupied or unattended. Section 130-6 deems such a vehicle a nuisance and a menace to the safe and proper regulation of traffic and says it shall be removed. Section 130-7 makes the owner pay the reasonable removal and storage cost.
Is there a fine for leaving a car on a snow-covered County road?
Article II prints no fine. Section 130-6 orders removal, and § 130-7 requires the owner to pay the reasonable cost of removal and storage, as provided in the Code of the County of Essex § 44-22, before regaining possession. The financial hit is the tow and storage charges.
Can I shovel my driveway snow into the County road in front of my house?
No. Section 130-8A bars any owner, occupant or other person fronting a County road from shoveling, piling, pushing, blowing, plowing or otherwise depositing snow onto the road. A violation, upon conviction, carries a $150 fine for the first offense and $300 for each subsequent offense.
Am I responsible if my plow contractor pushes snow onto a County road?
Yes, you can be. Section 130-8B says no person shall cause, sanction or authorize the prohibited activity, so directing or permitting a contractor to deposit snow on the road falls within the ban. Subsection D applies the same $150 first offense and $300 subsequent offense fines.
Do these rules apply on my town's streets in Essex County?
Chapter 130 governs County roads, and its snow articles are worded for County roads. Municipal streets in towns such as Newark or Montclair are outside these sections and follow each municipality's own code. Check the road's owner before relying on the $150 and $300 fines.
