Texas Local Government Code Section 229.001 expressly bars counties and cities from regulating private employer wages, including establishing a local minimum wage above state law. The Texas Minimum Wage Act adopts the federal Fair Labor Standards Act rate of 7.25 dollars per hour. Bexar County therefore has no authority to set a higher county-wide private-sector minimum wage. The county may set wages for its own employees and may impose living-wage standards on direct contractors, but cannot mandate private employer pay floors. Federal exemptions, tip credits, and overtime rules continue to apply unchanged inside Bexar County.
There are no county minimum wage violations because the county cannot enforce a higher rate. Private wage disputes are handled by the Texas Workforce Commission or U.S. Department of Labor under federal FLSA rules.
