Pender County, NC Environmental Rules: Boat Dock Permits (2026)

Chapter 14, Article II establishes Pender County's local implementation of North Carolina's Coastal Area Management Act permit program for Areas of Environmental Concern, which under state law cover estuarine waters, public trust areas and other coastal features where water-dependent structures such as docks, boat ramps, boathouses and bulkheads are sited. Section 14-19 sets the program's purpose as establishing procedures to be followed in issuing minor development permits in areas of environmental concern within the jurisdiction, coordinated with other local permits, while § 14-20 limits the county's administration to AEC areas inside Pender's boundaries that are not within Surf City's or Topsail Beach's own separate CAMA programs.

To apply, § 14-89(a) requires filing a completed application, approved by the coastal resources commission, with both the lead AEC permit officer and the state secretary of environment, health and natural resources, along with a fee the Board of Commissioners sets. Section 14-91(a) then gives the permit officer 30 days to decide, extendable once by another 30 days on written notice, and § 14-94 makes a missed deadline a passive approval with the full effect of an unconditioned grant. The permit officer's office sits in the Pender County Planning Department in Burgaw.

Section 14-21(b) supplies the penalty: undertaking development requiring a minor development permit without acquiring such a permit, exceeding the permit's authority, or violating conditions is a misdemeanor punishable by a $1,000.00 fine or up to 60 days imprisonment, or both, and the lead permit officer can also seek injunctive relief in the general court of justice.
