Newport Beach requires Coastal Development Permits for most development within the Coastal Zone under the city's certified Local Coastal Program. Much of Newport Beach lies within the California Coastal Zone, requiring Coastal Development Permits for new construction, additions, remodels exceeding 50% of structure value, grading, changes of use, and other development activities. The city's certified Local Coastal Program Implementation Plan (NBMC Title 21) establishes CDP requirements, exempt activities, and review procedures. Minor CDPs (waiver or de minimis) may be processed administratively for small projects. Standard CDPs require Planning Commission review with public hearing. The Coastal Commission retains original jurisdiction over tidelands, submerged lands, and public trust lands, and has appeal jurisdiction over projects between the sea and the first public road. CDP findings require adequate public access, protection of coastal views, compatibility with community character, minimized impacts to marine resources and environmentally sensitive habitat areas (ESHAs), and consistency with the certified Land Use Plan. Development without a required CDP is a violation of the Coastal Act and NBMC with potential fines up to $15,000 per day under California Public Resources Code Section 30820. Unpermitted development may require restoration of the site to pre-development conditions. The Coastal Commission may pursue independent enforcement.
