Section 46-253(b) bars releasing sediment, silt, earth or soil from clearing, grading or excavation beyond what on-site controls capture. Article 5.6 of the development code requires a stormwater management plan for subdivision and site plan applications inside the city and its extraterritorial jurisdiction, signed by an engineer licensed in Texas. Sites disturbing less than one acre are exempt unless part of a larger common development plan, as are agricultural activity and additions to existing single-family structures. Sites of one acre or more also fall under TCEQ's TPDES Construction General Permit TXR150000.
Each day and each section violated is a separate offense under section 46-293, punished by fine under section 1-13, and the city attorney may petition a court for an injunction.
