McCracken County, KY Environmental Rules: Erosion Control (2026)

Section 150.087(A) ties erosion control directly to development approval: no application for a final plan of subdivision may be approved unless it includes a plan describing the manner in which storm water runoff erosion and sediment resulting from the development will be controlled or managed, or a documented request for a waiver, and § 150.087(B) applies the same requirement, an approved erosion, sediment and storm water plan or a waiver, before any permit is issued for a lot or parcel. Section 150.089, EROSION CONTROL, then sets the design content: plans for storm water conveyance systems shall include appropriately designed temporary and permanent erosion-control measures for the open channel structures and all de-vegetated land draining to both open and closed conduits within the system, and directs designers to the Kentucky Natural Resources and Environmental Protection Cabinet's Best Management Practice for Construction Activities as the design manual.

Section 150.091(F) carries the same obligation into the final storm water management plan itself, requiring project specifications relative to erosion and sedimentation control that reference the same state BMP manual. Together the sections mean any grading, clearing or subdivision work that disturbs vegetation in unincorporated McCracken County must show, on paper, both temporary erosion controls during construction and permanent measures for the finished site before the Planning Commission or Building Inspector will sign off.
