Sioux Falls requires all construction and development sites to implement erosion and sediment control measures meeting city engineering design standards. An erosion control plan must be maintained on site throughout construction.
Under Β§ 157.175 (Subdivisions) and the city's Construction Erosion Control requirements, any construction activity disturbing soil must install and maintain best-management practices to prevent sediment from leaving the site. Developers must submit an erosion and sediment control plan approved by Engineering and must maintain a stormwater pollution prevention plan (SWPPP) regardless of site size. State NPDES permit coverage is required for disturbed areas of one acre or more. Two city staff members inspect active construction sites for compliance. Violations may result in stop-work orders.
Failure to maintain approved ESC measures may result in stop-work orders, mandatory corrective action, and civil penalties under the Sioux Falls Code.
