Summary

Carroll County requires the lowest floor of every new or substantially improved building in the floodplain to sit three feet above the base flood elevation, the freeboard standard set in the county's Floodplain Construction chapter. Basements are banned outright, and a licensed engineer or surveyor must certify the finished elevation on a FEMA elevation certificate.

These county ordinances apply to unincorporated areas of Carroll County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Section 3800.11. Elevation requirement. All new or substantially improved buildings or repair or reconstruction of repetitive loss shall have the lowest floor elevated three feet above the elevation of the base flood. Basements are not permitted. Less than substantial horizontal additions shall be elevated three feet above the elevation of the base flood. The elevation of the lowest floor shall be certified by a registered professional engineer or surveyor on the elevation certificate form and provided to the Code Official. Enclosures below three feet above the elevation of the base flood shall be constructed with water equalizing vents to meet the specifications of Section 3800.12.

Full Breakdown

005 calls the Floodplain Protection Elevation (FPE), the base flood elevation plus three feet. 11 requires the lowest floor of every new or substantially improved building, and of repair or reconstruction after a repetitive loss, to be elevated three feet above the base flood elevation. Basements are not permitted anywhere in that elevation zone, and even a less-than-substantial horizontal addition must meet the same three-foot freeboard. A registered professional engineer or land surveyor must certify the as-built lowest-floor elevation on the FEMA elevation certificate and submit it to the Code Official before the county will sign off.

12 requires flood openings on at least two different exterior walls, sized to one square inch of net opening per square foot of enclosed area (or an engineered equivalent), with opening bottoms no more than one foot above grade; those enclosed areas may be used only for parking, storage, or building access, and the owner must record a non-conversion agreement that the county inspects annually. 13 pushes the same three-foot freeboard down to utilities, requiring electric distribution panels, HVAC equipment, plumbing fixtures, and gas meters to sit at least three feet above the base flood elevation.

007(G) ties the same FPE to infrastructure: a publicly maintained street serving a new subdivision must be built at or above the FPE unless the county grants a variance.

Violations & Fines

Building below the required freeboard, or occupying an enclosure without approved flood openings and a recorded non-conversion agreement, is a code violation the county can catch at its mandatory foundation inspection before backfill and at the annual enclosure inspection. Under § 153.999, a conviction is a misdemeanor carrying up to $50,000 and a year in jail per violation, each day counting separately, on top of a civil penalty of up to $10,000 per day.

Frequently Asked Questions

How high above flood level must my house be built in Carroll County?
Three feet above the base flood elevation, measured to the lowest floor. Section 3800.11 of the county's Floodplain Construction chapter (added by § 170.15) applies that freeboard to all new construction, substantial improvements, and repairs after a repetitive flood loss, and it bans basements outright.
Can I finish or enclose the space under my elevated house?
Only for parking, storage, or access. Section 3800.12 requires at least two flood openings on different exterior walls sized to one square inch per square foot of enclosed area, and you must record a non-conversion agreement the county inspects once a year.
Do my electrical and plumbing systems need to be elevated too?
Yes. Section 3800.13 requires distribution panels, HVAC equipment, water heaters, plumbing fixtures, and gas meters to be installed at least three feet above the base flood elevation, the same freeboard that applies to the lowest floor.
Who certifies that my house meets the elevation requirement?
A registered professional engineer or licensed land surveyor completes a FEMA elevation certificate documenting the lowest floor's height and submits it to the Code Official, as required by Section 3800.11.
