Summary

Jefferson Parish sets its own floor-height floor on top of FEMA's base flood elevation: every new residential slab must sit at or above the BFE and never less than eighteen inches above the crown of the street, whichever is higher. Nonresidential slabs get a six-inch crown-of-street floor instead, and construction in V zones needs a Louisiana-licensed engineer's certification that the structure is anchored to pilings.

These county ordinances apply to unincorporated areas of Jefferson Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

The top of slab/floor for residential use, shall be at or above the base flood elevation established by the Federal Emergency Management Agency (FEMA) on its Flood Insurance Rate Map (FIRM). However, in all instances of residential use, the top of slab/floor shall not be less than eighteen (18) inches above the crown of the street. The top of slab/floor, for nonresidential use, shall be at or above the base flood elevation established by FEMA on its FIRM or the structure, together with all attendant utility and sanitary facilities, shall be floodproofed in accordance with CFR44. However, in all instances of nonresidential use, the top of slab/floor shall not be less than six (6) inches above the crown of the street. Exception: Accessory buildings two hundred (200) square feet or less used for parking or storage and having no utilities are exempt from these requirements. All construction in V zones shall also conform to the Federal Emergency Management Agency (FEMA) regulation and, further, a Louisiana State Registered Architect or Civil Engineer must certify that the structure is securely attached to adequately anchored pilings or columns.

Full Breakdown

The freeboard standard lives in Sec. 2, Slab/floor elevation regulations, inside the parish's Lot Grade and Building Elevation Regulations division, and it applies on top of whatever chapter 14 of the Code separately requires for floodplain management. For residential construction, the top of slab or floor must be at or above the base flood elevation shown on FEMA's Flood Insurance Rate Map for the lot, but the parish adds its own floor: regardless of what the FIRM shows, the slab can never sit less than eighteen inches above the crown of the adjacent street.

for elevation to the base flood elevation, provided all utility and sanitary equipment is included in that floodproofing. The parish carves out small accessory buildings entirely: structures of two hundred square feet or less used only for parking or storage, with no utilities run to them, do not have to meet either elevation standard. Anything built in a V zone, FEMA's highest-hazard coastal flood designation, must go further than a slab elevation: a Louisiana State Registered Architect or Civil Engineer has to certify that the structure is securely attached to adequately anchored pilings or columns, and the companion section, Sec. 1, extends the same base-flood-elevation floor to the lowest horizontal structural member of pier and chain-wall foundations used under manufactured homes.

Violations & Fines

Elevation compliance is checked at the building-permit and inspection stage under the Chapter 8 general enforcement rule, Sec. 8-1-107: building without meeting the required floor elevation, or without the FEMA and V-zone certifications this section demands, is a chapter violation. The Code Official issues a written notice citing the specific infraction, and a home built below its required elevation can be held up at final inspection until it is corrected.

Frequently Asked Questions

How high above the street must a new house be built in Jefferson Parish?
The slab or floor has to be at or above FEMA's base flood elevation for the lot, and the parish adds a hard floor on top of that: never less than eighteen inches above the crown of the adjacent street, whichever ends up higher. Sec. 8-2-111.2 applies this to all new residential construction parish-wide.
Are sheds and detached garages exempt from Jefferson Parish's flood elevation rule?
A shed or storage building of two hundred square feet or less, with no utilities connected, is exempt outright. A larger detached garage or accessory storage building is not exempt: the code treats it as nonresidential, so it must clear at least six inches above the crown of the street or meet the base flood elevation.
What extra certification applies in V zones?
Construction in a FEMA V zone, the parish's highest coastal wave-hazard designation, needs more than an elevated slab. A Louisiana State Registered Architect or Civil Engineer must certify that the structure is securely attached to adequately anchored pilings or columns before the Department of Building Permits will sign off.
