Summary

In unincorporated Lake County's Special Flood Hazard Areas, new or substantially improved residential structures must set the lowest floor, including any basement, at or above the Flood Protection Grade: two feet of freeboard above the base flood elevation. Non-residential buildings must meet the same mark or be floodproofed instead.

These county ordinances apply to unincorporated areas of Lake County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(B) Residential structures. New construction or substantial improvement of any residential structure (or manufactured home) shall have the lowest floor; including basement, at or above the FPG (two feet above the base flood elevation). Should solid foundation perimeter walls be used to elevate a structure, openings sufficient to facilitate the unimpeded movements of floodwaters shall be provided in accordance with the standards of division (D) below.

071(B) requires new construction or substantial improvement of any residential structure or manufactured home in the SFHA to have its lowest floor, including basement, built at or above that FPG. 071(C) must either be elevated to the FPG or fully floodproofed to that level, with the floodproofing design certified watertight by a registered professional engineer or architect and capable of resisting hydrostatic and hydrodynamic flood forces without human intervention or outside electricity. 071(A): new construction over 400 square feet, an addition or improvement costing 50% or more of the structure's value, repair of damage costing 50% or more of pre-damage market value, installing a manufactured home or a travel trailer or RV on site more than 180 days, or repair of a repetitive-loss structure.

071(D): at least two openings in two different exterior walls sized to one square inch of net opening per square foot of enclosed area, with the bottom of each opening no more than one foot above grade, and the enclosed space below the FPG left unfinished and unpartitioned. 071(E) must be compacted to 95% of maximum density, extend at least ten feet beyond the foundation before sloping below the base flood elevation, and be protected against erosion. 051(B) and (C).

Violations & Fines

Failure to obtain a floodplain development permit, or failure to meet the terms of a permit or a use variance, is a violation of Chapter 157 under § 157.999, treated as a common nuisance under Zoning Ordinance No. 11 and punishable by the fine set in § 154.999(F). Each day a violation continues is a separate offense. The Lake County Plan Commission must also notify the owner that a willful violation increasing flood damage risk can cause a Standard Flood Insurance Policy to be suspended, and the county may pursue any other lawful remedy, with costs charged to the responsible party. Skipping the as-built elevation certificate before further construction is itself grounds for the Floodplain Administrator to issue a stop-work order under § 157.051(B).
