Summary

New residential construction in a Thornton special flood hazard area must set its lowest floor at least one foot above the base flood elevation, City Code Section 22-311(b)(1)a. Substantially improved or renovated homes in the flood hazard area need the same one-foot freeboard above the base flood elevation, and the elevation must be certified by a licensed Colorado engineer, architect, or surveyor.

New construction and substantial improvement and/or reconstruction of any residential structure shall have the lowest floor (including basement), electrical, heating, ventilation, plumbing, and air conditioning equipment and other service facilities (including ductwork), elevated to one foot above the base flood elevation. This includes external mechanical and electrical equipment such as air conditioning compressors, meters, and master switches. Upon completion of the structure, the elevation of the lowest floor, including basement, shall be certified by a registered Colorado professional engineer, architect, or land surveyor on the prescribed FEMA form. Such certification shall be submitted to the floodplain administrator for approval and maintained by the floodplain administrator thereafter. In addition to the requirement of paragraph a. above, any substantial improvement, renovation, reconstruction or repair of residential structures that are in the special flood hazard area shall be constructed with the lowest floor, including basements, placed with a minimum of one foot of Freeboard above the base flood elevation or model-backed approximate flood elevation.

Full Breakdown

Section 22-311(b)(1)a requires that new construction, substantial improvement, or reconstruction of any residential structure in Thornton's special flood hazard area have its lowest floor, including the basement, along with all electrical, heating, ventilation, plumbing, and air conditioning equipment and service facilities, elevated to at least one foot above the base flood elevation; this covers external equipment too, such as air conditioning compressors, meters, and master switches. Once built, the lowest-floor elevation must be certified by a registered Colorado professional engineer, architect, or land surveyor on the prescribed FEMA form, and that certification is submitted to and kept by the floodplain administrator.

Section 22-311(b)(1)b layers on a freeboard requirement for substantial improvements, renovations, reconstructions, or repairs of residential structures in the special flood hazard area: the lowest floor, including basements, must be placed with a minimum of one foot of freeboard above the base flood elevation or the model-backed approximate flood elevation. In AO and AH flood zones on the FIRM, Section 22-311(b)(1)c requires the lowest floor to sit above the highest adjacent grade at least as high as the depth number shown on the FIRM plus one foot of freeboard, or at least two feet if no depth number is given.

Nonresidential structures face a parallel standard under Section 22-311(b)(2): the lowest floor and utility equipment must be elevated the same amount, or the structure and its utilities must be floodproofed watertight to at least one foot above the base flood level with walls able to resist hydrostatic and hydrodynamic loads.

Violations & Fines

Constructing or substantially improving a residential structure in the special flood hazard area without meeting the one-foot freeboard elevation, or without submitting the required engineer or surveyor elevation certification, violates Article VI and is unlawful under Section 22-194(a). The floodplain administrator can withhold a certificate of occupancy until the certified elevation is on file, and violators face daily separate offenses punishable under Section 1-8, alongside possible injunctive action under Section 22-195.

Frequently Asked Questions

How much freeboard does Thornton require above the base flood elevation?
At least one foot. Section 22-311(b)(1)a requires new residential construction to set its lowest floor, including basement and all mechanical equipment, one foot above the base flood elevation, and Section 22-311(b)(1)b applies the same one-foot freeboard to substantial improvements and reconstructions of existing homes in the flood hazard area.
Who has to certify the elevation of a home built in a Thornton flood hazard area?
A registered Colorado professional engineer, architect, or land surveyor, using the prescribed FEMA elevation certificate form, per Section 22-311(b)(1)a. That certification is submitted to the floodplain administrator, who keeps it on file and can require it before issuing a certificate of occupancy.
What if my property is in an AO or AH flood zone instead of a mapped base flood elevation area?
Section 22-311(b)(1)c still requires elevation: the lowest floor must sit above the highest adjacent grade at least as high as the depth number shown on the FIRM, plus one foot of freeboard, or at least two feet if the FIRM lists no depth number.
