Summary

New construction and substantially improved homes in Miami-Dade's Special Flood Hazard Areas must have their lowest floor elevated to or above the base flood elevation plus a mandatory freeboard margin before a building permit issues.

(b)Residential structures. No new construction or substantial improvement of any residential structure shall be permitted in an SFHA, and no building permit shall be issued therefor, unless said new construction, reconstruction, or substantial improvement complies with the following: (1) The structure's lowest floor (including basement) and any attached garages or enclosures and detached accessory buildings shall be elevated to or above the base flood elevation plus freeboard, except as provided in paragraph (4) below.

Chapter 11C requires new construction and substantially improved residential structures in a Special Flood Hazard Area (SFHA) to have their lowest floor, attached garages, enclosures and detached accessory buildings elevated to or above the base flood elevation plus freeboard, with electrical, plumbing and mechanical systems also kept above that line. Freeboard is defined as the stricter of one foot above base flood elevation or the higher minimum set by the Florida Building Code and ASCE 24. Nonresidential structures may floodproof instead, but never more than 10 feet below the base flood elevation. The chapter applies in unincorporated Miami-Dade (UMSA) and in any incorporated area where the County retains exclusive development-permit jurisdiction; the 34 municipalities otherwise enforce their own floodplain codes.
