Nonresidential buildings must clear four inches above base flood elevation or be engineer-certified as dry floodproofed.
(a)Residential construction. New construction or substantial improvement of any residential building shall have the lowest floor, including basement, equipment and mechanical items elevated to or above the highest elevation as prescribed in ASCE 24, or eight inches above the crown of the road or back of sidewalk elevation abutting the property, whichever is higher. If solid foundation perimeter walls are used to elevate a structure, openings sufficient to facilitate the equalization of hydrostatic forces on two sides of exterior walls in according to the standards of subsection (c) herein are required.
Full Breakdown
Sec. 42-51(a) sets the residential freeboard: the lowest floor, including basement and all mechanical equipment, must be elevated to the highest elevation prescribed by ASCE 24 or eight inches above the crown of the road or back of sidewalk abutting the property, whichever is higher. If solid perimeter foundation walls are used, flood-vent openings meeting Sec. 42-51(c)'s equalization standard are required. Sec. 42-51(b) sets the nonresidential standard at four inches above base flood elevation, the crown of the road, or ASCE 24, whichever is higher, with dry floodproofing allowed as a certified alternative in A-zones.
Manufactured homes placed in flood hazard areas must be elevated so the lowest floor sits at or above base flood elevation plus one foot (Sec. 42-51(f)(3)). Enclosed areas below the lowest floor may only be used for parking, storage or building access, cannot be finished into rooms, and require the owner to sign and record a non-conversion agreement with the Miami-Dade County Clerk of Courts (Sec. 42-51(d)). The building official serves as floodplain administrator (Sec. 42-29(d)) and reviews an elevation certificate at both the construction and completion stages before a certificate of occupancy issues (Sec.
42-40). A variance from these standards costs $150 to apply for and requires the city council, sitting as the variance board, to find exceptional hardship (Sec. 42-61(b), (c)).
Violations & Fines
A structure lacking an elevation certificate or other required compliance documentation is presumed to be in violation until proof is submitted (Sec. 42-26 definition of "Violation"). Uncorrected deficiencies block issuance of a certificate of occupancy or completion and can trigger a stop-work order under Sec. 42-40(b); chapter 42 violations otherwise fall under the general code enforcement civil-penalty process in chapter 22.
