Summary

Any use, activity, or development in a Lynchburg floodplain district, including replacing a manufactured home, needs a permit before work starts. The floodplain administrator reviews every application for compliance with state and federal law and bars anything that would reduce a watercourse's flood-carrying capacity, while a defined list of uses is banned outright.

(a)Permit requirement. All uses, activities, and development occurring within any Floodplain District, including replacement of manufactured homes, shall be undertaken only upon the issuance of a permit. Such development shall be undertaken only in strict compliance with the provisions of this ordinance and with all other applicable codes and ordinances, as amended, such as the Virginia Uniform Statewide Building Code and the city's Subdivision Ordinance. Prior to the issuance of any such permit, the floodplain administrator shall require all applications to include compliance with all applicable State and Federal laws and shall review all sites to assure they are reasonably safe from flooding. Under no circumstances shall any use, activity, and/or development adversely affect the capacity of the channels or floodways of any watercourse, drainage ditch, or any other drainage facility or system.

Full Breakdown

1(a) requires a permit for all uses, activities, and development within any Floodplain District, and ties that permit to compliance with the Virginia Uniform Statewide Building Code and the City's Subdivision Ordinance. Before issuing a permit, the floodplain administrator must confirm the application meets applicable state and federal law and review the site to ensure it is reasonably safe from flooding; no permitted activity may reduce the flood-carrying capacity of any channel, watercourse, or drainage facility. 2 bars any new construction and allows only encroachments proven, through engineering analysis, not to raise flood levels, while manufactured homes are prohibited there except as replacements in an existing manufactured home park.

In the Floodway Fringe and Approximated Floodplain areas, cumulative development cannot raise the base flood water surface elevation. 10, including sanitary landfills, junkyards, outdoor storage of inoperative vehicles, surface mines and borrow pits, bulk storage of petroleum, chemical, or hazardous materials, and any emergency service, medical service, or governmental records storage facility, with no expansion of a nonconforming use of that kind allowed. 4. 15.

Violations & Fines

Developing in a floodplain district without the required permit, or violating any floodplain use restriction, is enforced as a Zoning Ordinance violation under Section 35.2-102: a misdemeanor fine of up to $1,000.00, with each successive 30-day period of noncompliance a separate offense. Sellers who fail to disclose floodplain regulation in writing under Section 35.2-59.15 face the same penalty. The floodplain administrator may also pursue civil enforcement, including injunctions, to stop unpermitted work.

Frequently Asked Questions

Do I need a permit to build in a Lynchburg flood zone?
Yes. Section 35.2-59.8.1(a) requires a permit for any use, activity, or development within a Floodplain District, including replacing a manufactured home. The floodplain administrator reviews the application for compliance with state and federal law and must confirm the site is reasonably safe from flooding before issuing that permit.
What land uses are completely banned in Lynchburg's flood hazard districts?
Section 35.2-59.10 bans sanitary landfills, junkyards, outdoor storage of inoperative vehicles, surface mines, borrow pits, bulk storage or manufacture of petroleum, chemical, or hazardous materials, and any emergency service, medical service, or governmental records storage use in every special flood hazard district, with no exceptions for expanding an existing nonconforming version of these uses.
Can I build in the Floodway District if I'm not raising flood levels?
New construction is barred outright in the Floodway District under Section 35.2-59.7.2. Only an encroachment or improvement to an existing structure may proceed, and only after hydrologic and hydraulic analysis demonstrates it will not increase flood levels in the community during the base flood, subject to the floodplain administrator's review.
