In the Town of Stedman, North Carolina, lots inside a special flood hazard area cannot be created or developed as building sites in any subdivision, group development or mobile home park unless the plat maps the 100-year floodplain boundary and follows the exceptions in Subdivision Ordinance Section 3.16.

SECTION 3.16. LOTS SUBJECT TO FLOODING (Amd. 4-6-2000) Lots located, in whole or in part, in areas of special flood hazard, as such term is defined in Chapter 6.5 (Flood Damage Prevention Ordinance) of the Cumberland County Code, shall not be established or developed in any type of subdivision, group development, mobile home park or any other type of development for the purpose of creating building sites, except as herein provided. a. The preliminary and finals plats of subdivisions, group developments, or mobile home parks, or sections thereof, in which there are areas of special flood hazard, shall have a line or lines drawn thereon delineating the boundaries of such areas within the subdivision, group development, or mobile home park. Each such boundary line shall be the same as the boundary line(s) of the 100-year special flood hazard area as shown on the official flood maps of Cumberland County.

Full Breakdown

5, the Flood Damage Prevention Ordinance, of the Cumberland County Code, except as the section itself allows. A preliminary or final plat covering land in a subdivision, group development or mobile home park that touches special flood hazard area must show a line delineating the boundary of that area, matching the 100-year special flood hazard boundary shown on Cumberland County's official Flood Boundary and Floodway Map or Flood Insurance Rate Map, labeled the '100-year floodplain,' and annotated with the map's effective date, community number and map number plus a notice that FEMA can revise the line.

Where a levee is proposed to alter the floodplain line, the plat must add a levee base contour line, a line twenty feet outside it, a revised floodplain line once FEMA approves the levee, and a twenty-foot watercourse maintenance line along any watercourse whose flow the levee would restrict. 5 and may be limited or precluded by it. A final plat proposing to alter the floodplain by levee cannot be approved for a downstream lot until the revised floodplain line is annotated on the plat. 5.

Violations & Fines

A plat that omits the required floodplain boundary line, levee contour lines, watercourse maintenance line or the printed FEMA notice cannot receive preliminary or final approval from the Town. Selling or creating a downstream lot before the revised 100-year floodplain line is annotated on the final plat is barred outright under subsection d. Any dispute over the County Engineer's floodplain determination is appealed to the Stedman Board of Adjustment under Zoning Ordinance Section 12.4.

Frequently Asked Questions

Can a new lot be created inside Stedman's 100-year floodplain?
Only if the plat maps the special flood hazard boundary exactly as shown on Cumberland County's official flood maps and meets the notice and levee-line requirements of Subdivision Ordinance Section 3.16; otherwise the Town will not approve the preliminary or final plat.
Who decides whether my land is in Stedman's special flood hazard area?
The Cumberland County Engineer reviews the plat against Chapter 6.5 of the Cumberland County Code and reports to the Stedman Planning Director; a disputed determination is appealed to the Stedman Board of Adjustment under Zoning Ordinance Section 12.4.
Does building a levee let a developer build on Stedman floodplain land?
Only after FEMA approves the levee and the official flood maps are revised; until then the plat is treated as unprotected floodplain, and a downstream lot cannot be sold until the revised floodplain line is annotated on the final plat.
