Full Breakdown
Brevard County's floodplain ordinance governs unincorporated Brevard only. Melbourne, Palm Bay, Titusville, Cocoa, Cocoa Beach, Rockledge, Satellite Beach and other Space Coast cities administer their own separate flood damage prevention codes. In FEMA-mapped special flood hazard areas, new residential construction and substantial improvements must have the lowest floor, including any basement, elevated at least 12 inches above the base flood elevation; nonresidential buildings may floodproof instead if certified by a licensed engineer. Manufactured homes must be elevated and anchored with tie-downs rated to 4,800 pounds. Coastal high-hazard V-zones require elevation on pilings above base flood elevation, with breakaway walls below the lowest floor. The county building official reviews and must approve the base flood elevation for every development permit issued in these areas.
Violations & Fines
Violating the floodplain construction standards is a code offense punishable by a fine of up to $500, up to 60 days in jail, or both, with each day of continued violation counted as a separate offense.
