TCEQ rule 30 TAC 114.512 prohibits commercial vehicles with gross vehicle weight rating over 14,000 pounds from idling for more than five consecutive minutes when not in motion in the Houston-Galveston-Brazoria ozone nonattainment area, which covers Harris, Brazoria, Chambers, Fort Bend, Galveston, Liberty, Montgomery, and Waller counties. The rule applies April through October when ground-level ozone formation is highest. Sleeper-berth occupancy, emergency vehicles, traffic-flow delays, equipment-power needs, and vehicle maintenance are exempt under 114.517. The Harris County Pollution Control Services Department investigates complaints and supports TCEQ enforcement. Federal EPA mobile-source rules also apply at port and industrial facilities.
Idling violations under 30 TAC 114.512 carry TCEQ administrative penalties up to twenty-five thousand dollars per day per violation. Harris County Pollution Control works with TCEQ Region 12 to issue notices, settlements, and abatement orders.
