Portland, ME Environmental Rules: Vehicle Idling Restrictions (2026)

Sec. 28-195 of Chapter 28's Police Traffic Division applies only to gasoline-powered private passenger vehicles; commercial vehicles and others already regulated under 38 M.R.S.A. § 585-K fall outside it. Subsection (b) sets the operative rule: no person may cause or allow a private passenger motor vehicle to idle for more than five consecutive minutes in any sixty-minute period, where "idle" means the primary propulsion engine is running while the vehicle is stationary and not engaged in gear to power the drive train.

Seven exceptions in subsection (c) keep the limit from reaching normal driving and safety situations: idling stuck in a traffic jam beyond the driver's control; running a defroster, heater or air conditioner to prevent a safety or health emergency (not as a rest period); idling required for maintenance, servicing, repair or diagnostic work; idling during a state or federal equipment inspection; idling caused by mechanical trouble, provided the owner mails repair paperwork or a receipt to the enforcing authority within 30 days; up to ten additional minutes of heating when the outside temperature is 32°F or below; and unlimited heating idling once the temperature drops below 0°F.

Subsection (d) makes a parked, idling vehicle prima facie evidence that the registered owner caused or allowed the violation. The police department and the parking division, through police officers and parking control officers, enforce the section. A conviction carries a minimum $50.00 penalty, but a violator may instead pay a $25.00 waiver fee within ten days of receiving a notice of violation or summons. Subsection (e)(4) provided a 180-day written-warning grace period after the section's effective date before full enforcement began, a transition tied to Ordinance No. 64-08/09, adopted September 15, 2008.
