An illicit discharge is any discharge to the Municipal Separate Storm Sewer System (MS4) that is not composed entirely of stormwater. Violators are subject to administrative fines ($100 first offense, doubling for repeats, up to $5,000/day under CA Water Code), mandatory cleanup, and potential referral to the Regional Water Board for civil penalties up to $25,000 per day under the Clean Water Act. Businesses with ongoing compliance issues may be required to submit a Stormwater Pollution Prevention Plan (SWPPP).
