Erie's Stormwater Quality Management Ordinance (Article 946, Ord. 20-2004) governs runoff, infiltration, and BMP maintenance under PA Act 167 and the PADEP NPDES MS4 permit. A separate Article 948 stormwater utility fee, enacted in fall 2022, funds the aging system.
Erie's stormwater program sits across three frameworks: the federal NPDES MS4 permit (PADEP, 25 Pa. Code Chapter 92a), the PA Stormwater Management Act (Act 167, 32 P.S. 680.1) implemented through the Erie County Act 167 Plan, and Article 946 of Erie's Codified Ordinances (Ord. 20-2004). The ordinance targets infiltration, groundwater recharge, and water-quality compliance with 25 Pa. Code 93.4a, and requires permanent operation and maintenance of BMPs. Article 948, adopted in fall 2022, established the Stormwater Management System User Fee on developed parcels. Earth disturbance over the Act 167 thresholds requires a stormwater management plan reviewed by the City Engineer and Erie County Conservation District.
Discharging non-stormwater into the MS4, failing to maintain a required BMP, or developing without an approved stormwater plan violates Article 946 and the city's NPDES permit. PADEP can pursue civil penalties under the Clean Streams Law.
