No person shall develop or redevelop any land without having met the provisions of this Division by providing appropriate stormwater management measures that control or manage runoff, except as provided within Section 32-174 of this Division. ... Planning techniques, nonstructural practices, and design methods specified in the Maryland Design Manual and the Prince George's County Design Manual shall be used to implement ESD to the MEP. The use of ESD planning techniques and treatment practices must be exhausted before any structural BMP is implemented. ... Any person convicted of violating the provisions of this Division shall be guilty of a misdemeanor, and upon conviction thereof, shall be subject to a fine of not more than Ten Thousand Dollars ($10,000.00), or imprisonment not exceeding one (1) year, or both, for each violation, with costs imposed at the discretion of the court and not to exceed Fifty Thousand Dollars ($50,000.00).
