Shelby, MI Environmental Rules: Stormwater Management (2026)

Chapter 490's groundwater protection article (Sections 490-53 through 490-57) of the Village of Shelby Code applies to "all businesses and facilities, including private and public facilities, which use, store, or generate substances in quantities greater than 100 kilograms per month (equal to about 25 gallons or 220 pounds), and which require site plan review," per Section 490-55. Once a project crosses that threshold, Section 490-56A(2) requires stormwater management and drainage facilities to retain the natural retention and storage capacity of any wetland, water body, or watercourse, and bars any design that would increase flooding, the potential for environmental contamination on-site or off-site, or cause a third party to lose the use of property.

Industrial sites with a point-source stormwater discharge must also keep a stormwater pollution prevention plan that satisfies state and federal rules, Section 490-56A(3), and any general-purpose floor drain has to tie into the public sewer, an on-site holding tank, or a state-permitted discharge system, Section 490-56A(4). At the review stage, Section 490-57D pushes the design detail further: the site plan must specify the location of every exterior drain, dry well, catch basin, retention/detention area and sump used to collect, store or transport stormwater or wastewater, with the point of discharge for every drain and pipe marked on the plan.

Applicants also submit a Hazardous Materials Report and a Village of Shelby Environmental Permits Checklist alongside the drainage layout, Section 490-57F and G. The article's stated goals, set out earlier in Section 490-53, include protecting the Village's drinking-water wellhead area and meeting state wellhead-protection requirements, so the stormwater standards are written to keep contaminated runoff away from Village wells as much as to control flooding.
