The Town of Vienna lies within the Chesapeake Bay watershed and is subject to both the Chesapeake Bay Preservation Act (VA Code Β§62.1-44.15:67) and the Virginia Stormwater Management Act (VA Code Β§62.1-44.15:24). Any land-disturbing activity of 2,500 square feet or more, including residential additions, pool installations, and regrading, typically requires a Chesapeake Bay exception review or VSMP permit through the Town. Resource Protection Areas (RPAs) along streams, wetlands, and their 100-foot buffers have additional restrictions on clearing, impervious surface, and septic system placement. New impervious surface must be offset through stormwater best management practices such as rain gardens, dry wells, or pervious pavers. Erosion and sediment control measures (silt fence, construction entrance, inlet protection) must be installed before grading begins. The Town inspects during construction and at final stabilization. Violations carry civil penalties up to $32,500 per day under state law.
