Eagan requires the finished side to face out, holds fences to district height limits, and bars temporary fences (snow/erosion) beyond thirty (30) days without City approval. Beyond height and permits, Eagan imposes installation and maintenance requirements on fences. Every fence must be maintained in accordance with the City's building and structure safety and appearance regulations. No temporary fence, such as a snow fence or an erosion-control fence, may remain on any property for more than thirty (30) days unless otherwise approved by the City for good cause. A fence is treated as a public nuisance if it is not firmly fastened and anchored (leaning or near collapse), is not maintained in sound and good repair, has rotting pieces or unintended holes, breaks, or gaps, or presents a hazard. Exterior wood surfaces other than decay-resistant woods must be protected by paint or another treatment kept in good repair, and no fence section may have peeling, cracked, or otherwise deteriorated finish on more than twenty percent (20%) of any one linear ten-foot (10') section. For swimming pools, the City requires every outdoor pool to be completely enclosed by a security fence or wall at least four but not more than six feet high, located at least four feet from the edge of the pool. The finished side of all fences must face away from the owner's lot, and the entire fence and footings must sit inside the property line.
A fence that is leaning, rotting, broken, has more than 20% deteriorated finish on any 10-foot section, or a temporary fence left up beyond 30 days, may be declared a public nuisance, prompting an abatement notice, repair or removal orders, and potential City enforcement costs charged to the owner.
