Eagan, MN Fence Regulations: Height Limits (2026)

City Code § 11.70, Subd. 16.B sets Eagan's residential fence heights: side and rear yard fences cannot exceed six feet, and front yard fences are capped at 42 inches, roughly three and a half feet. Subd. 16.C allows business and industrial property-line fences up to eight feet, but anything taller needs a conditional use permit from the council. Corner lots carry an extra restriction: Subd. 16.B.1 subjects any fence erected within 30 feet of the intersecting curbline to the citywide traffic visibility rule in § 11.40, Subd.

6, which bans any structure or planting over 30 inches above the curb inside a triangular sight zone running 30 feet along each curb from the point where the two street curblines meet. That triangle exists specifically to keep drivers' sightlines clear at intersections, so even a code-compliant six-foot side yard fence has to step down near a corner. Subd. 16.A.1 requires every fence to be maintained to the building and structure safety and appearance standards in Chapter 10, and bars any temporary fence, such as a snow fence or erosion-control fence, from staying up more than 30 days without city approval for good cause.

Community Development's code enforcement and building inspection staff review fence height at permit issuance and can act on complaints once a fence is built, since no separate fence permit hearing is otherwise required for a residential yard fence within these limits.
