Allegany County, MD Fence Regulations: Height Limits (2026)

Section 360-129D, part of the Article XVIII accessory-structures and fences rules, does not set a maximum fence height for residential or other lots; a fence's height instead becomes relevant only through the corner-visibility-triangle rule. No new fence, wall, structure, plant or other barrier to vision or sight distance may be installed within a radius of 20 feet from the right-of-way line where any road, street or driveway meets a county- or state-maintained road or street, or within a radius of 55 feet from where the center lines of those roads, streets or driveways intersect.

The rule applies to any obstruction, not just solid fencing, so dense hedges and landscaping features fall under it if they block a driver's sight line at the intersection. The same subsection adds a second, unrelated restriction: no fence, wall or other obstruction may be placed in a stream channel in a way that impedes the stream's flow or causes backwater flooding of properties upstream, tying fence placement to the county's floodplain and drainage concerns under Chapter 325. Because there is no county-wide numeric height cap, a homeowner building a tall privacy fence away from an intersection and outside a stream channel is not capped by Part 4 zoning, though other chapters, such as the Building Code adopted at Chapter 255, or private covenants outside the county's authority, can still impose their own limits.
