Under Annapolis City Code § 21.60.070(B)(9)(a), fences and walls in the R2-NC, R3-NC and R3-NC2 Residential Neighborhood Conservation Districts cannot exceed four feet in height when located along a public street; the same cap extends to the WME, WMM and OCD districts where a fence sits along a lot line or street contiguous with an R2-NC property. The Director of Planning and Zoning may administratively allow up to four additional feet above that standard, and decorative gates get two extra feet (§ 21.60.070(B)(10)). Every fence or wall needs a Department of Planning and Zoning permit before it is erected, altered, or replaced (§ 17.34.010(A)(1)), and at every intersection a sight-visibility triangle must stay clear of obstructions between two-and-a-half and twelve feet above the street (§ 21.60.075).

Erecting a fence without a permit, or over height, violates §§ 17.34.010 and 21.60.070 and is a municipal infraction carrying a civil fine set by City Council resolution; each day the violation continues is a separate offense (§ 17.34.030).
