In unincorporated San Bernardino County, Development Code Chapter 83.06 caps fences, hedges, and walls within required setbacks. Residential and other districts allow 4 ft in front and street-side setbacks and 6 ft in interior side and rear setbacks (Table 83-6). RC and RL districts allow open fences up to 5 ft in front and street-side setbacks.
San Bernardino County regulates fences in the unincorporated areas through Section 83.06.030 (General Height Limitations) of the Development Code, which sets maximum heights within required setback areas in Table 83-6. For "All other land use zoning districts" (which includes residential zones such as RL, RS, and RM), the maximum is 4 ft in the front and street-side setbacks and 6 ft in the interior side and rear setbacks. Commercial districts allow 4 ft front/street-side and 10 ft interior-side/rear; industrial districts allow 6 ft front/street-side and 10 ft interior-side/rear, but projects adjacent to residential districts must use the "All other" standard. A footnote to Table 83-6 provides that in the RC (Rural Conservation) and RL (Rural Living) districts, open fences may go up to 5 ft in the front and street-side setbacks. Heights above these standards may be allowed by an approved Use Permit, Variance, Tract or Parcel Map, or when required by the County for health and safety. Outside required setbacks (in the buildable interior of a lot), Chapter 83.06 does not impose these setback-area caps. Per Section 83.06.040, fence/wall height is measured from finished grade at the location of the fence; where adjacent parcels differ in grade, height along the property line is measured from the lowest contiguous parcel.
Building a fence taller than the Table 83-6 limit within a required setback without an approved Use Permit, Variance, or map approval can trigger a County code-enforcement notice, an order to lower or remove the fence, and possible penalties. A separate building permit is also required for any fence or block wall over 7 ft in height.
