LDC Sec. 34-1744 sets heights for fences and walls other than residential project fences. Between a street right-of-way or easement and the minimum required street setback line the cap is three feet, or four feet if the fence is open mesh screening that does not interfere with vehicle visibility. Along a secondary street right-of-way six feet is allowed if the fence is set back five feet and meets visibility rules. Between a side or rear lot line and the minimum accessory building setback line the maximum is six feet. Within 25 feet of a waterway a fence must be open mesh above three and one-half feet. Commercial, industrial and agricultural fences may reach eight feet.

An over-height or misplaced fence is a Land Development Code violation. The Hearing Examiner may impose $25.00 to $1,000.00 per day for a first violation and $50.00 to $5,000.00 per day for repeats.
