Summary

Spokane County caps residential fences at six feet and nonresidential fences at eight feet. In the front or flanking street yard of a residential lot the cap drops to three feet for a sight-obscuring fence and four feet for a non-sight-obscuring fence. No fence or structure can stand inside the clear view triangle, which for local streets runs one hundred fifteen feet along each centerline.

These county ordinances apply to unincorporated areas of Spokane County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Fence height shall comply with the following standards. a. Residential fences are allowed up to six feet in height. b. Nonresidential fences are allowed up to eight feet in height. c. Fences within a front or flanking street yard of a residential lot are limited as follows. i. The maximum height for a sight-obscuring fence shall be three feet. ii. The maximum height for a non-sight-obscuring fence shall be four feet. A residential fence exceeding a height of six feet requires a variance from the hearing body. ... Sight obstructions, including fencing or structures, shall not be permitted within a "clear view triangle," as determined by the Spokane County Division of Engineering. Clear view triangles are established according to the following standards. a. Local access streets: The clear view triangle is determined by measuring one hundred fifteen feet from the center of two intersecting local access streets along the centerlines of each local access street, then connecting the two points with a straight line forming the hypotenuse of the clear view triangle.

Full Breakdown

Chapter 14.812 of the Spokane County Code sets fence height in the unincorporated county through two linked sections. SCC 14.812.100(1) fixes the base heights: residential fences are allowed up to six feet and nonresidential fences up to eight feet. A stricter cap applies in the front or flanking street yard of a residential lot, where a sight-obscuring fence tops out at three feet and a non-sight-obscuring fence at four feet. A residential fence taller than six feet requires a variance from the hearing body.

The code builds in two flexibilities. Inside a planned unit development, a fence can exceed the stated limit when it is designated on an approved preliminary site plan. Hedges, shrubbery or other materials serving the same function as a fence can be used in place of a fence, but only if they are not part of the required landscaping. Section 14.812.100(1)(e) then ties every fence to the clear view triangle, so a fence that meets the height table can still be illegal at a corner.

SCC 14.812.200 is the sight line rule. Sight obstructions, including fencing and structures, are not permitted inside a clear view triangle as determined by the Spokane County Division of Engineering. For two intersecting local access streets, the triangle is found by measuring one hundred fifteen feet from the center of the intersection along the centerline of each street and joining the two points with a straight line, which forms the hypotenuse. At arterial intersections the Division of Engineering points designers to pages 654 to 680 of the AASHTO geometric design policy and will help a project designer who does not have the guide. Trees inside the triangle must have their branches removed at the trunk from ground level to a minimum of eight feet above ground level, and shrubs or other vegetation must be kept no higher than three feet above the grade of the adjacent street centerline.

Violations & Fines

Fence violations are zoning code violations under chapter 14.408, enforced by the planning director. A violation is a misdemeanor punishable by up to ninety days in the county jail, a fine of up to $1,000 fixed by the court, or both, and each day the violation exists is a separate offense. The enforcement authority can instead issue a civil notice of violation: $200 at Level I and $500 at Level II, plus $50 for each day the violation continues, with further add-ons for repeat offenders.

Frequently Asked Questions

How tall can a front yard fence be in Spokane County?
In the front or flanking street yard of a residential lot, a sight-obscuring fence cannot exceed three feet and a non-sight-obscuring fence cannot exceed four feet. The six foot residential limit applies elsewhere on the lot, and nonresidential fences are allowed up to eight feet. Every fence must also stay out of the clear view triangle at street corners.
Can I build a residential fence taller than six feet?
Only with a variance from the hearing body. Under chapter 14.406 the hearing examiner can grant a variance from the zoning code, and the application is a type II project permit with a public hearing and a fee set by the board. Inside a planned unit development, a taller fence is allowed if it is designated on an approved preliminary site plan.
How far back from a corner must I keep clear?
At two intersecting local access streets, measure one hundred fifteen feet from the center of the intersection along each street centerline and connect the two points with a straight line. Nothing in that triangle can obstruct sight. For arterial intersections the Spokane County Division of Engineering determines the triangle using the AASHTO design policy.
How high can plants grow inside the clear view triangle?
Shrubs and other vegetation must be kept no higher than three feet above the grade elevation of the centerline of the adjacent street. Trees must have their branches removed at the trunk from ground level up to a minimum of eight feet above ground level, so drivers can see under the canopy.
How do I contest a civil fence violation notice?
File a notice of appeal with the enforcement authority within fourteen days of service of a Level I notice of violation, or of a Level II notice when it is the first citation. The appeal goes to the county hearing examiner and must come with a fee set by the board to cover processing and legal advertising.
